This means both\u00a0people must\u00a0agree that the activity take place, whether it involves touching, kissing, or any other type of sexual act. The consent must be clear, informed, and given freely. Otherwise, the activity is considered\u00a0sexual assault.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Consent must be clear<\/strong><\/h5>\n<p>When giving consent, a person can say they\u2019re in agreement with their partner\u2019s actions. They can express their consent through words, an attitude, or actions, like a smile. \u00a0<\/p>\n<p>A person who says or does nothing isn\u2019t consenting to sexual activity. They don\u2019t have to resist physically in order to show they don\u2019t consent. \u00a0<\/p>\n<p>Also, the consent must be given by the person involved. It can\u2019t be given by someone else.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Making sure the partner consents<\/strong><\/h5>\n<p>Partners must take reasonable steps to make sure the other person consents, for example, by asking the person if they agree to take part in a sexual activity or asking whether they\u2019re enjoying the activity.<\/p>\n<p>Consent must be given once again before beginning a different sexual activity.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Saying yes to certain sexual activities and no to others<\/strong><\/h5>\n<p>A person can consent to certain sexual activities and not to others. For example, a person can consent to a kiss but refuse to have sex.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Saying yes, then changing their mind during the sexual activity<\/strong><\/h5>\n<p>A person can change their mind about a sexual activity at any time. As soon as one person refuses, whether through words or actions, the sexual activity must stop.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Consent must be informed and given freely<\/strong><\/h5>\n<p>There are situations where a person\u2019s consent is invalid because it was not informed or given freely. This is the case when a partner feels forced to agree, or if the partner agrees but isn\u2019t aware of certain major risks.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Force or threats<\/strong><\/h5>\n<p>A person\u2019s consent is invalid if they accept to participate in\u00a0sexual activity because they\u2019re physically forced to or have been threatened.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Authority and abuse of power\/abuse of trust<\/strong><\/h5>\n<p>A person can consent to sexual activity with a person in a position of authority\/trust, such as their direct supervisor or their doctor.\u00a0However, their consent is\u00a0invalid\u00a0if they feel they must agree because the other person is using their position, role, or status. A person might be taking advantage of their position even if they don\u2019t have the actual power to penalize the other person.<\/p>\n<p><strong>Important!<\/strong>\u00a0Specific rules apply in the case of\u00a0teenagers.<\/p>\n<p>Some lies can invalidate consent<\/p>\n<p>A person\u2019s consent is invalid if their partner lies and exposes them to a serious risk of harm or injury. This is the case, for example, if a\u00a0person living with HIV\u00a0doesn\u2019t tell their partner about it and there\u2019s a reasonable risk of transmission. The partner\u2019s consent may be considered invalid in this type of situation.\u00a0<\/p>\n<p>The same applies if a person lies about using contraception and exposes their partner to a risk of pregnancy.\u00a0<\/p>\n<p>Important: Experiencing stress or sadness because the other sexual partner lied isn\u2019t enough to invalidate consent. For example, if you agree to have sex with a person who says they\u2019re single, your consent to sexual activity is valid even if you later learn that the person is married.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>The partner must be able to consent<\/strong><\/h5>\n<p>A person must\u00a0capable\u00a0of giving consent in order for their consent to be valid. The law provides certain situations where a person\u2019s consent is invalid.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Person who is asleep or unconscious<\/strong><\/h5>\n<p>A person who is asleep or unconscious isn\u2019t able to consent to sexual activity. Their consent is invalid, even if they gave their consent before falling asleep or losing consciousness.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Severe alcohol or drug intoxication<\/strong><\/h5>\n<p>A person who has consumed alcohol or drugs is usually able to consent to sexual activity, even if impaired. But their consent is invalid if they no longer realize what they\u2019re doing or if they\u2019re unconscious, for example, if they blacked out or have fallen into an alcohol-induced coma. \u00a0<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Minimum age for consent \u00a0<\/strong><\/h5>\n<p>The minimum age to consent to sexual activity is 16.\u00a0Before age 16, an adolescent can consent\u00a0to sexual activity if their partner is about the same age.<\/p>\n<p>&nbsp;<\/p>\n<h5><strong>Verifying your partner\u2019s consent\u00a0<\/strong><\/h5>\n<p>A person\u00a0must always\u00a0take reasonable steps to make sure their partner\u00a0consents. This could be, for\u00a0example, by\u00a0asking them if\u00a0they agree to participate in the sexual activity or they are enjoying\u00a0the activity.\u00a0\u00a0<\/p>\n<p>Consent must be given for every sexual act involved.
